Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Plok mobile app, the Plok API, and the website at plok.app (collectively, the “Service”), which are operated by Plok App LLC (“Plok,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Plok helps users analyze screenshots and organize derived results. Features may change over time, and we may add, modify, suspend, or discontinue all or part of the Service at any time.

2. Acceptable use

You may use the Service only in compliance with applicable law.

You agree not to:

• Use the Service in a way that violates the rights of others.
• Submit content you do not have the right to use or share.
• Interfere with or disrupt the Service or its infrastructure.
• Attempt to gain unauthorized access to the Service or related systems.
• Circumvent subscription, entitlement, or access controls.
• Reverse engineer, decompile, or otherwise attempt to extract source code or protected logic except where prohibited by law.
• Use the Service to develop or train a competing service using our outputs or systems in an abusive or unauthorized way.

3. Your content

You retain ownership of the screenshots, text, and other content you submit to the Service.

By using the Service, you grant Plok App LLC and its service providers a limited, non-exclusive right to host, transmit, process, analyze, adapt, and display that content only as needed to operate, support, secure, and improve the Service.

You are responsible for the content you submit and represent that you have the rights and permissions necessary to submit it for processing.

4. AI and generated results

The Service uses automated systems, including AI models and third-party enrichment providers, to generate results.

You understand and agree that:

• Results may be incomplete, inaccurate, outdated, or unavailable.
• Results are provided for convenience and informational purposes.
• You are responsible for reviewing and independently evaluating any output before relying on it.

Plok does not guarantee the accuracy, completeness, or usefulness of any result, recommendation, match, classification, extracted data, or link.

5. Subscriptions, billing, and entitlements

Some features may require a paid subscription or other entitlement.

If you purchase a subscription:

• Billing is processed through the applicable app store and supporting billing providers.
• Pricing, billing cycles, auto-renewal, cancellation, and refund rights are presented at checkout or governed by the rules of the platform through which you purchased.
• You are responsible for managing your subscription through your Apple App Store or Google Play account, as applicable.
• Except where required by law, refunds are handled by the platform through which the purchase was made.

6. Third-party services and links

The Service relies on third-party services and may link to external websites, products, maps, stores, or media platforms.

We do not control and are not responsible for:

• Third-party content or availability.
• Third-party terms or privacy practices.
• Any products, services, or actions of third parties.

Your use of third-party services is governed by their own terms and policies.

7. Intellectual property

The Service, including its software, branding, design, text, graphics, and related content other than user-submitted content, is owned by Plok App LLC or its licensors and is protected by intellectual property and other applicable laws. These Terms do not grant you any ownership rights in the Service.

8. Termination

We may suspend or terminate access to all or part of the Service if:

• You violate these Terms.
• Your use creates risk for us or others.
• We are required to do so by law.
• We decide to discontinue the Service.

Termination will not affect any rights or obligations that by their nature should survive termination.

9. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, error-free, or that defects will be corrected.

10. Limitation of liability

To the maximum extent permitted by law, Plok App LLC and its affiliates, members, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or use, arising out of or relating to the Service or these Terms.

To the maximum extent permitted by law, our aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of $100 USD or the amount you paid us, if any, in the 12 months before the event giving rise to the claim.

11. Indemnity

You agree to defend, indemnify, and hold harmless Plok App LLC and its affiliates, members, officers, employees, contractors, licensors, and service providers from and against claims, damages, liabilities, losses, and expenses arising out of or related to:

• Your use of the Service.
• Your content.
• Your violation of these Terms.
• Your violation of applicable law or the rights of a third party.

12. Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to that jurisdiction and venue.

13. Changes to these Terms

We may update these Terms from time to time. If we do, we will post the updated version and revise the “Last updated” date. Your continued use of the Service after the updated Terms become effective means you accept the revised Terms.
